The High Court has rejected a petition challenging the constitutionality of the 13 members of the National Dialogue Committee (NADCO). Justice Mugambi ruled that the case was filed prematurely, stating that the court’s jurisdiction was invoked to address a non-existent dispute.
Justice Mugambi emphasized that the court should not engage in matters before they are ripe for adjudication. “The doctrine of ripeness applies in this case. This court upholds the preliminary objections and strikes out the petition in its entirety,” the ruling stated.
In the case, the respondents, represented by lawyer Arnold Oginga, argued that the court lacked jurisdiction to hear the petition, highlighting that the doctrine of ripeness discourages filing cases before a matter has fully developed into a controversy.
