Guinea’s draft constitution was released online by the National Transition Council early Monday morning, setting the stage for elections and a return to constitutional governance before the year’s end.
The proposed constitution introduces a bicameral system with a National Assembly and a Senate. It retains progressive elements from the 2020 Constitution, such as the abolition of the death penalty and the prohibition of female genital mutilation. Additionally, it guarantees that anyone arrested, detained, or charged must be informed of the reasons for their arrest. The draft also enforces a strict two-term limit for the presidency, each term lasting five years.
However, there is uncertainty regarding the status of General Mamady Doumbouya, who has led Guinea since a 2021 coup. While the transition charter prohibits him from running for president in future elections, this restriction is not mentioned in the draft constitution, leading to speculation that he might be eligible to run.
